1. Introduction

These Terms & Conditions (“Terms”) govern your use of the Aqua Sharks Atlantic website and participation in our swimming programmes, squads, lessons, and related services.

By registering, enrolling, or using our services, you agree to be bound by these Terms.

2. Services

Aqua Sharks Atlantic provides:

Learn-to-swim programmes

Squad training (junior, senior, and adult)

Private swimming lessons

Swim fitness programmes

All services are subject to availability and may be amended from time to time.

3. Registration & Enrolment

All swimmers must complete a registration form prior to participation.

Information provided must be accurate and complete.

For swimmers under 18, a parent or legal guardian must complete the registration.

Placement into squads is determined by Aqua Sharks Atlantic based on age, ability, and assessment.

4. Fees & Payment

Fees are payable in advance as communicated upon registration.

Aqua Sharks Atlantic reserves the right to suspend participation for non-payment.

Fees are subject to change with reasonable notice.

Any additional costs (e.g. competitions, events, equipment) will be communicated separately.

5. Cancellations & Refunds

Notice of cancellation must be provided in writing.

Refunds are not guaranteed and may be subject to administrative fees.

No refunds will be issued for missed sessions unless otherwise agreed.

Aqua Sharks Atlantic reserves the right to cancel sessions due to weather, safety, or operational reasons.

6. Attendance & Punctuality

Swimmers are expected to arrive on time for sessions.

Missed sessions are not automatically rescheduled.

Consistent attendance is required for progression between squads.

7. Health & Medical Conditions

Any medical conditions must be disclosed during registration.

Aqua Sharks Atlantic reserves the right to request medical clearance where necessary.

Participation is at the swimmer’s own risk, subject to the supervision provided.

8. Safety & Conduct

Swimmers must follow all instructions given by coaches and staff.

Disruptive, unsafe, or inappropriate behaviour may result in removal from sessions.

Aqua Sharks Atlantic reserves the right to suspend or terminate participation where necessary.

9. Parental Responsibility (Minors)

Parents/guardians must ensure swimmers are supervised before and after sessions.

Aqua Sharks Atlantic is responsible only during scheduled session times.

Emergency contact details must be kept up to date.

10. Liability

Aqua Sharks Atlantic, its coaches, and staff will take all reasonable precautions to ensure safety.

However, participation in swimming activities carries inherent risks.

Aqua Sharks Atlantic shall not be held liable for any injury, loss, or damage except where caused by gross negligence.

11. Personal Belongings

Swimmers are responsible for their own belongings.

Aqua Sharks Atlantic is not liable for lost, stolen, or damaged items.

12. Photography & Media

Photos or videos may be taken during sessions for promotional purposes.

By enrolling, you consent to the use of such media unless you notify us in writing.

13. POPIA & Privacy

Personal information is collected and processed in accordance with our Privacy Policy.

By registering, you consent to the use of your information for operational and communication purposes.

14. Communication

Communication may be conducted via email, phone, or WhatsApp.

It is the responsibility of the swimmer or parent/guardian to ensure contact details are accurate.

15. Changes to Programmes & Terms

Aqua Sharks Atlantic reserves the right to:

Adjust schedules

Change coaches

Update programmes

Amend these Terms

Any updates will be communicated where applicable.

16. Termination of Services

Aqua Sharks Atlantic reserves the right to suspend or terminate participation:

For non-payment

For breach of these Terms

For unsafe or inappropriate behaviour

17. Governing Law

These Terms are governed by the laws of the Republic of South Africa.
